Terms of Service

These Terms of Service ("Terms") govern access to and use of the Omnicloud console, API and related services (the "Service"), operated by Omnicloud. By creating an account or using the Service you agree to these Terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
Omnicloud provides a control panel and API for provisioning and managing cloud infrastructure — compute instances, storage, networking, Kubernetes clusters, databases and related resources — running on OpenStack across one or more regions. Features, regions and pricing may change as the Service evolves.
2. Accounts
You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity that occurs under your account and team, including actions taken by anyone you invite. Notify us immediately of any unauthorized use.
3. Acceptable use
You may not use the Service to host or distribute unlawful content, malware, or material that infringes a third party’s rights; to attack, scan or disrupt systems you do not own or have permission to test; to send unsolicited bulk communications; or to circumvent usage limits, billing or security controls. We may suspend or terminate resources or accounts that violate this section, with notice where practicable.
4. Billing and payment
Paid resources are billed on the cycle and rates shown in the console at the time of use, in the currency configured for your account. Fees are payable through the payment methods we support and, unless stated otherwise, are non-refundable once the billing period has started. Failure to pay may result in suspension of resources.
5. Your content and data
You retain all rights to the data, workloads and content you deploy on the Service ("Customer Data"). We access Customer Data only as needed to operate, secure and support the Service, or as required by law. You are responsible for backing up Customer Data and for complying with any law that applies to it.
6. Availability and support
We aim to keep the Service available and will communicate planned maintenance where possible, but we do not guarantee uninterrupted operation. Support is available through the channels listed in the console and on our website.
7. Suspension and termination
Either party may stop using or providing the Service at any time. We may suspend or terminate access immediately for a breach of these Terms, non-payment, legal requirements, or risk to the Service or other customers. On termination, outstanding fees remain due and we may delete resources after a reasonable notice period.
8. Disclaimers and liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Omnicloud disclaims warranties of any kind and is not liable for indirect, incidental or consequential damages arising from use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the console or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
